Terms of service

1. Who you are contracting with

This site is operated by Loftstead LLC, a Arizona limited liability company with its place of business at 1180 Pinehurst Trace, Suite 210, Scottsdale, AZ 85254, United States. In these terms, we, us and our mean that company.

2. Eligibility

You must be at least 18 years old and able to enter a binding contract, and you must provide a shipping address inside the United States. Orders that do not meet these conditions will be cancelled and refunded in full.

3. Products and descriptions

We describe each product against its actual specification and photograph the physical item. Screens vary, so exact colour rendering can differ. If a product materially differs from its description when it arrives, that is a defect and we replace or refund it.

4. Prices

Prices are in USD and are the amounts charged at checkout. When an item is discounted we display the exact sale price alongside the original list price, and the list price shown is a price the item was genuinely offered at.

Prices are validated on our server against our own catalog when a checkout session is created. If a price displayed in your browser does not match our catalog, the catalog price governs, and we will tell you before taking payment.

Obvious pricing errors do not create a contract. If an error is caught after payment we cancel the order and refund in full rather than ship at a price nobody intended.

5. Orders and acceptance

Placing an order is an offer to buy. The contract forms when we confirm dispatch. Until then we may decline an order, for example if stock is exhausted or an address cannot be served, and any payment taken is refunded in full.

6. Payment

Payment is taken by Stripe on a hosted page. We never receive your full card number. By paying you authorise the total shown on that page, which includes any sales tax that applies to your state. Shipping is free.

7. Delivery and risk

Delivery estimates are estimates, not guarantees. Title and risk pass to you on delivery to the address you supplied. Full detail is in the shipping policy, which forms part of these terms.

8. Cancellation and returns

You can cancel before an order enters fulfilment by emailing orders@loftstead.com with your order number. After delivery you have 30 days to return anything under the returns policy, which also forms part of these terms. No restocking fee and no return shipping fee.

9. Warranty

Two year limited warranty against manufacturing defects applies for 2 years from delivery and covers manufacturing defects in normal use. It does not cover impact damage, misuse, or ordinary wear on grips, pads and finishes. This warranty is in addition to any rights you have by law.

10. Authenticity

Our authenticity guarantee applies to items bought on this site only. Products bought from any other seller are outside these terms.

11. Acceptable use

Do not attempt to interfere with the site, place automated bulk orders, scrape at a rate that degrades service, or use our brand, photography or text without written permission. We may refuse service where any of this occurs.

12. Intellectual property

The name Loftstead, the mark, the product photography and the text on this site belong to Loftstead LLC. You may share links freely. You may not reproduce the assets commercially.

13. Limitation of liability

Our total liability arising from an order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, including lost tee times, travel costs or competition entry fees. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

14. Governing law

These terms are governed by the laws of the State of Arizona and the courts located in Scottsdale, AZ have exclusive jurisdiction, without affecting any right you have to bring a claim where you live.

15. Changes

We may update these terms. The version in force for your order is the version published when you placed it, and the effective date at the top identifies the current one.
